This Acceptable Use Policy ("AUP") governs your use of Nexitel Inc ("Nexitel") services and forms part of our Terms of Service. Violation of this AUP may result in reduced speeds, suspension, or termination without refund.
1. Permitted Use
The Services are for lawful, personal, non-commercial use unless a plan expressly permits otherwise. "Unlimited" features are intended for normal individual use and are subject to the fair-use and network-management terms below.
2. Prohibited Conduct
You may not use the Services to:
- violate any law, regulation, or third-party right;
- send unlawful, fraudulent, harassing, or unsolicited bulk communications (spam);
- engage in fraud, identity theft, SIM trafficking, or unauthorized resale of Services;
- access, tamper with, or disrupt any network, system, or host carrier;
- use automated, machine-to-machine, or continuous high-volume traffic on plans not designated for such use;
- bypass, resell, or rebroadcast Services, or use the line for call-center, robocalling, telemarketing, or commercial routing unless expressly authorized;
- use the Services in a way that degrades the host network or harms other users; or
- circumvent fair-use, data, or speed limits.
3. Fair Use and Network Management
To protect network integrity and all users, we and the host networks may apply network-management practices, including prioritization, speed reduction (throttling), and limits on excessive usage. Plans described as "unlimited" remain subject to these practices and to deprioritization during congestion.
4. International Calling Abuse
International calling allotments, including those described as "unlimited," are for ordinary personal use. We may limit, suspend, or terminate international calling that we reasonably determine to be excessive, automated, commercial, or indicative of abuse or fraud.
5. Fraud and Chargeback Abuse
Using the Services and then initiating a chargeback or refund demand on a delivered product, repeatedly purchasing and disputing, or using stolen payment credentials is strictly prohibited and may result in immediate termination, recovery of amounts owed, and referral to authorities.
6. Enforcement
We may investigate suspected violations and take any action we deem appropriate, including reducing speeds, suspending or terminating Services, removing access, and reporting to host networks or authorities — without refund and, where appropriate, without prior notice.
